Terms of Service

1. Agreement to terms
By accessing or using the services provided by Haumaru Ltd ("Haumaru", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services or website.
2. Services
Haumaru provides cybersecurity services including but not limited to:
- Managed detection and response (MDR)
- Penetration testing and offensive security assessments
- Security architecture and consulting
- Incident response and digital forensics
- Compliance and governance advisory
Specific service terms, scope, and deliverables are defined in individual service agreements or statements of work.
3. Client obligations
When engaging our services, you agree to:
- Provide accurate and complete information necessary for service delivery
- Maintain appropriate authorisation for any systems subject to testing or assessment
- Not use our services for any unlawful purpose
- Comply with all applicable New Zealand laws and regulations
- Promptly notify us of any changes that may affect service delivery
4. Intellectual property
All tools, methodologies, reports, and deliverables produced by Haumaru remain our intellectual property unless explicitly assigned in a service agreement. You receive a non-exclusive licence to use deliverables for your internal business purposes.
5. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information disclosed during the engagement. This obligation survives the termination of any service agreement. Specific confidentiality terms are detailed in our service agreements and NDAs.
6. Limitation of liability
To the maximum extent permitted by New Zealand law:
- Haumaru's total liability for any claim arising from our services shall not exceed the fees paid for the specific service giving rise to the claim
- We are not liable for indirect, incidental, or consequential damages
- We do not guarantee that security assessments will identify all vulnerabilities or that our services will prevent all security incidents
7. Indemnification
You agree to indemnify and hold harmless Haumaru from any claims, damages, or expenses arising from your breach of these terms, misuse of our services, or violation of any applicable law.
8. Termination
Either party may terminate a service engagement in accordance with the applicable service agreement. We reserve the right to suspend or terminate access to our services immediately if you breach these terms or engage in conduct that could harm our systems, reputation, or other clients.
9. Governing law
These terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
10. Changes to these terms
We may update these terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised terms. Material changes will be communicated to active clients.
